Subject to the condition listed below, PHPMyAffiliates grants you worldwide, non-exclusive use of any and all source code, scripts, licencing and documentation (Collectively termed "software") provided on the PHPMyAffiliates Website Domain (phpmyaffiliates.infobuoy.com) free of charge unless otherwise explicitly stated.

You agree:
  • to place an unobstructed, visible and functional link to http://www.infobuoy.com on a verifiably genuine Web page on any and all domains that make use of PHPMyAffiliates software - for as long as any software from PHPMyAffiliate, in whole or in part, remain on your servers.
  • not to damage InfoBuoy's standing by placing links to InfoBuoy on sites or areas that contain illegal material or any content tantamount to hate speech, racism, child pornography or any other illicit activities
  • not to deliberately mis-spell or modify the names InfoBuoy or PHPMyAffiliates when placing links on your site
  • not to copy, modify, sublicense, or distribute the software under any circumstances
  • not to charge a fee for providing services performed by PHPMyAffiliates software
  • not to modify the software unless given express permission to do so by PHPMyAffiliates
  • THAT BECAUSE THE PROGRAM IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTY FOR THE PROGRAM, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES PROVIDE THE PROGRAM "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
  • that if you do not accept these Terms of Service you MAY NOT use ANY of the software provided by PHPMyAffiliates although you may still make use of the Website
Changed Terms
PHPMyAffiliates shall have the right at any time to impose, change or modify its fees and billing methods, or other terms and conditions applicable to your use of the software or to impose new terms and conditions. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the PHPMyAffiliates Site a revised version of this Agreement or notification by electronic or conventional mail.

If any such change is unacceptable to you, you may terminate your association with us in writing. Any use of the software by you after such notice shall conclusively be deemed to constitute acceptance by you of such changes, modifications, additions or deletions. You agree to review the terms and conditions periodically to be aware of such revisions.

Endorsements
PHPMyAffiliates does not endorse, warrant or guarantee any products or services offered through the PHPMyAffiliates site and will not be a party to or in any way monitor any transaction between users and third party providers of products or services. As with the purchase of a product or service through any medium or in an environment, you should use your best judgement and exercise caution where appropriate.

Disclaimer of Warranty & Limitation of Liability
You expressly agree that use of the PHPMyAffiliates Site is at your sole risk. Neither PHPMyAffiliates, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that the PHPMyAffiliates site will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the PHPMyAffiliates site or as to the accuracy, reliability or content of any information, service or products provided through the sites or the community areas.

PHPMyAffiliates makes products or services available on the PHPMyAffiliates site without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

Content Submission
Any material submitted for display on the PHPMyAffiliates site must:
  • be an original work, or credited to the original author or copyright owner
  • not be an advertisement for products or services or be promotional copy
  • be well written and in English
  • not contain pornography or obscene material
  • not be tantamount to racism or hate speech or in any way illegal
PHPMyAffiliates reserves the right to edit any material before posting it to the site. We also reserve the right to reject any submissions based on our own criteria.

By submitting an article you agree that you are legally entitled to share and publish that content and that submitting an article to PHPMYAffiliates in no way constrains or limits us in our choice of future articles - regardless of whether or not their content is related or similar and regardless of whether your content is or isn't accepted and published by us.
